One problem that can come up for an employer is when they wish to hire someone who signed a non-compete contract at the previous place of employment.

When the new employee is has an agreement that was signed then this needs to be reviewed by the new employer and the employee must also be very clear on what their obligations may be.

In general, under Florida employment laws non-compete agreements are valid. Problems arise when employers make the contracts overly broad. An overly broad non compete agreement might be one which sets an unrealistic amount of time that the employee is not allowed to work in their profession. The geographical area covered by the non-compete agreement may also be much larger than required for the business interests of the employer. These factors and others must be considered when preparing or signing a non-compete agreement.

Sometime a new employer wanting a way out for the new employee will suggest that the former employer broke the agreement so that it is no longer valid. This is actually possible but could also result in some pretty substantial problems for the new employer if they just take this position without first seeking legal council.
